These terms govern your use of joshuajames.tv (the “site”), which is operated by Joshua James through MTN Records (the “owner”) in American Fork, Utah. By visiting or using the site, you agree to these terms. If you do not agree, please do not use the site.
What this site is
The site is a personal place for music, words, tour dates, and a little bit of business. It is not a store of record — records are sold through Bandcamp and other partners, each with their own terms.
Ownership and copyright
All recordings, songs, lyrics, photographs, illustrations, writing, and design on the site are copyright Joshua James / MTN Records or their respective owners and are protected under United States and international copyright law. All rights are reserved unless granted explicitly below or in writing.
What you can do
You are welcome to read, listen, share links to the site on social media or by email, quote brief passages with credit, and link to any public page here. If you write about Joshua James, you may use the photos in the press kit (when one is published) within the terms posted alongside it.
What you cannot do
- Copy, republish, redistribute, or sell any music, lyrics, photographs, or other content from the site without written permission;
- Scrape or harvest the site in bulk, or use automated tools to reproduce it;
- Train artificial intelligence or machine-learning models on any music, lyrics, audio, photographs, or writing from the site without express written permission;
- Use any name, mark, or artwork from the site in a way that suggests endorsement, sponsorship, or affiliation when none has been granted;
- Attempt to break, probe, overload, or interfere with the site, its servers, or other visitors.
If you want to use something for a project — a film, a podcast, a piece of writing, a benefit show — please write to theamericanfork@gmail.com. Most reasonable requests get a reasonable answer.
Booking inquiries and other messages
When you submit the tour booking form, the studio inquiry form, or write a message, you confirm that the information you provide is accurate and that you have the authority to make the request you are making. A response is not a contract; a confirmed show or session is created only by a separate written agreement. Studio rates listed on the site are starting points, not offers — final pricing is agreed in writing before a session.
Third-party services and links
The site embeds Bandcamp players and links to other services such as Spotify, Apple Music, YouTube Music, Tidal, Amazon Music, and the merchandise partner’s storefront. Those services are operated by independent companies under their own terms and privacy policies, and the owner is not responsible for their conduct, content, or availability.
Disclaimers
The site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Tour dates, prices, and other details can change without notice; confirm anything important before relying on it.
Limitation of liability
To the maximum extent allowed by law, the owner is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the site — including lost profits, lost data, or business interruption — even if the owner has been advised of the possibility of such damages. The owner’s total liability for any direct damages will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow these limits, so they may not apply to you.
Indemnification
You agree to defend and hold harmless the owner from any claim or demand arising from your misuse of the site, your violation of these terms, or your infringement of any third party’s rights.
Governing law
These terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-laws rules. Any dispute that cannot be worked out informally will be brought in the state or federal courts located in Utah County, Utah, and you consent to the jurisdiction of those courts.
